Search and Seizure

You have certain rights under the 4th amendment of the constitution. If you are arrested or being investigated for a criminal offense, the constitution protects you against warrantless searches and seizures. Police need to have a proper reason to investigate you in the first place, and secondly, they need to search in a place where the potential evidence they are searching for could be looking for. For example, if police are looking for a suitcase, they cannot search the glove compartment of your car because a suitcase cannot possibly fit in the glove compartment.

If you think you have been the victim of an unreasonable search, you have options. If police obtain evidence through an unreasonable search than it cannot be used against you. This can be vital to the outcome of your case. You are innocent until proven guilty, so if you or someone you know is being criminally investigated, contact NNK law at 972-399-4878 today.
