Paternity Issues

In Texas, there is a presumption that a child born within a marriage is the husband’s child. If a child is born to two people out of wedlock, the father can be established one of two ways: firstly, through consent (by signing the birth certificate of the child); or secondly, through a paternity test.

Establishing paternity can be important for the mother or legal guardian of the child because it means the father is legally responsible for paying child support and has to fulfill certain obligations.

Establishing paternity can also be important for a father who wants to exercise his parental rights and have a relationship with his child.
